UBCIC Calls For Moratorium On All Private Power Facility Development on Rivers and Streams

RE: Private Water Power Licences

WHEREAS the UBCIC is a political organization for Indigenous peoples in British Columbia founded in 1969, dedicated to promoting and supporting the efforts of Indigenous people to affirm and defend Aboriginal Title and Rights;

WHEREAS our Indigenous Rights are recognized by the Constitution of Canada and have been re-affirmed by the provincial and federal courts;

WHEREAS First Nations call for full and meaningful consultation and accommodation of any development proposals within their respective territories;

WHEREAS the Government of British Columbia has and continues to grant water licences for the sole purpose of “small-scale” power generation;

WHEREAS the full revenue potential of such licences require significant development on the affected river and transmission corridors;

WHEREAS the environmental and cumulative impacts of such developments on a watershed level have not been fully addressed;

THEREFORE BE IT RESOLVED that the UBCIC Chiefs Council call for a moratorium on all private power facility development on rivers and streams until such time as there is an assurance for transparent consultation on any private power development agreement;

THEREFORE BE IT FURTHER RESOLVED that the terms and conditions of the existing licensed and operating water power facilities be reviewed to ensure that the meaningful consultation intent of court decisions such as the Haida and Taku River Tlingit decisions;

THEREFORE BE IT FURTHER RESOLVED that the UBCIC Chiefs Council supports those First Nations who are currently negotiating or have secured a private power agreement;

THEREFORE BE IT FINALLY RESOLVED the Chiefs Council direct the Union of BC Indian Chiefs to work with the BC Assembly of First Nations and the First Nations Summit to prioritize this issue as a political agenda item of the BC First Nation Leadership Council.
